Protect Your Band!
You've put your time and effort into your band,
make sure you protect yourself.
You can protect your band name and/or logo with a
trademark (a service mark is a type of trademark). A trademark provides significant protection and costs more
than a copyright. A copyright will protect the artistic aspects of
your music, while a trademark will protect your band name as a musical
artist. This provides you with great protections in the US and

The government is very strict about how it issues trademarks. They
limit trademarks by putting things into different classifications of
goods and services. A trademark covers only a very limited set of
goods or services. Live performances and musical CDs are in different
classes. One government fee only covers one of the categories, if you
wish to cover both, you will need to pay two fees.
Many bands have many trademarks to cover all of their types of goods
and services (for example, Metallica has 42 trademarks) but most only
have one, two, or three. Many bands choose only to have their live
musical performances covered if they only cover one and add music CDs
as their second (You must have at least two CDs in order to trademark
for CDs). We can cover the other later as well as any additional
